Terms of Service

These Terms govern access to the Service, advertising submissions, user-curated lists, review, payment, ranking, publication, and related use of the platform.

These Terms govern access to the Service, advertising submissions, user-curated lists, review, payment, ranking, publication, and related use of the platform.

These Terms of Service ("Terms") are a binding agreement between you and Desinet d/b/a Podium Atlas ("Podium Atlas," "we," "us," or "our") governing your access to and use of PodiumAtlas.com, any related advertiser dashboard, upload flows, ranking surfaces, list creation and participation surfaces, payment flows, reporting tools, and related services (collectively, the "Service").

By accessing or using the Service, creating an account, creating or participating in lists, uploading or editing advertising materials, submitting an advertisement, funding an advertisement, or otherwise interacting with the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, you must not use the Service.

1. Eligibility; Authority; Accounts

You represent and warrant that you are legally able to enter into a binding agreement. If you use the Service on behalf of a company, brand, or other organization, you represent and warrant that you have authority to bind that organization to these Terms.

You must provide accurate, current, and complete account information and keep that information updated. You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. You must promptly notify Podium Atlas of any unauthorized use of your account or any security incident involving your account.

2. The Service

The Service is a ranked discovery platform through which users may browse, create, and participate in user-curated lists, and through which advertisers may submit, manage, and fund advertisements for possible review, approval, ranking, and display on the Service.

For purposes of these Terms, "Advertiser" means any user or entity that submits, uploads, edits, funds, or otherwise manages advertising materials through the Service. "Advertising Content" means all text, images, logos, trademarks, designs, creative materials, destination URLs, claims, metadata, linked materials, and other content submitted to or used in connection with an advertisement. "List Content" means list titles, descriptions, items, rankings, tiers, images, links, submissions, and other content or signals submitted to or used in connection with user-curated lists.

Podium Atlas may modify, suspend, discontinue, or limit any part of the Service at any time.

3. Review; Approval; Publication; Platform Control

All Advertising Content is subject to review before publication and may also be reviewed after publication. Podium Atlas may, at any time and in its discretion, approve, reject, suspend, remove, disable, reclassify, reformat, limit, or require modification of any advertisement or account.

These actions may be taken for operational, legal, technical, payment, safety, reputational, anti-abuse, policy, or quality reasons, or for no stated reason. Podium Atlas has no obligation to provide advance notice, a warning, or an explanation for any decision.

Payment, submission, upload, review, estimate display, or prior approval does not obligate Podium Atlas to publish or continue publishing any advertisement. Removal of an advertisement for payment-related reasons, including failed, reversed, or disputed payments, does not trigger any refund obligation except as stated in Section 9.

  • return an advertisement to review status; and
  • restrict, suspend, or terminate an account.

4. Advertiser Responsibilities; Representations; Warranties

Advertisers are solely responsible for all Advertising Content and all activity conducted through their accounts. List creators and participants are solely responsible for the List Content, submissions, rankings, tiers, links, and other activity they contribute through their accounts.

You represent, warrant, and covenant that you own or control, or have obtained all rights, licenses, permissions, and authorizations necessary to use, upload, display, publish, store, reproduce, distribute, and link all Advertising Content and List Content you submit or control.

You further represent, warrant, and covenant that you have the lawful right to use all images, trademarks, logos, text, designs, rankings, list entries, and linked content you submit; that your advertisements, lists, submissions, claims, destination content, and linked content are accurate, non-misleading, lawful, and not fraudulent or deceptive; that they do not infringe, misappropriate, or otherwise violate any third-party intellectual property, privacy, publicity, contractual, or other rights; that destination URLs and linked content are functional, relevant, and free of malware, malicious code, deceptive redirects, or other harmful content; and that your use of the Service complies with applicable law, these Terms, and any technical or submission requirements communicated through the Service.

You must not use the Service to publish or promote content that is unlawful, misleading, defamatory, infringing, fraudulent, abusive, harmful, manipulative, or otherwise objectionable. You must not attempt to manipulate ranking, evade review, interfere with reporting, abuse payment flows, or use automation or other methods to distort platform operations.

5. Advertising Standards and Acceptable Use

Advertisements must be suitable for the Service and their selected category. Podium Atlas may refuse or remove content that it determines is inconsistent with platform standards, legal requirements, payment processor requirements, safety concerns, or public trust.

Podium Atlas may require substantiation for claims, request changes, or refuse categories or submissions that it determines are not suitable for the Service.

  • make false, misleading, or unsubstantiated claims;
  • impersonate another person, business, brand, or affiliation;
  • submit infringing or unauthorized creative;
  • direct users to unlawful, unsafe, malicious, or materially inconsistent destination content;
  • engage in fraud, abuse, spam, ranking manipulation, list manipulation, submission manipulation, evasion, scraping, or other misuse of the Service; or
  • use the Service in a manner that creates excessive operational, legal, payment, or reputational risk.

6. Intellectual Property Complaints

If you believe that content on the Service infringes your intellectual property rights, please contact Podium Atlas at support@mail.podiumatlas.com with a description of the allegedly infringing content, the location of that content on the Service, and sufficient information to identify your claim. Podium Atlas will review notices submitted in good faith and may take action it deems appropriate, including removal of the identified content.

Podium Atlas respects intellectual property rights and expects Advertisers to do the same. Repeat infringers may have their accounts terminated.

7. License to Advertising Content and List Content

As between you and Podium Atlas, you retain whatever ownership rights you have in your Advertising Content and List Content. You grant Podium Atlas a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, cache, reproduce, display, perform, transmit, distribute, publish, moderate, review, and otherwise use that content as necessary to operate, provide, secure, review, support, analyze, promote, and improve the Service.

This license includes the right to modify Advertising Content and List Content for technical and presentation purposes, including resizing, cropping, compressing, reformatting, excerpting, generating previews, and adapting layout or file format as needed for the Service.

The license survives for so long as reasonably necessary to operate the Service, preserve records, resolve disputes, comply with law, maintain backups, or enforce rights arising from your use of the Service.

8. Rankings; Estimates; No Guarantee of Outcome

The Service uses a dynamic ranking and placement system. Ranking methodology, weights, thresholds, decay logic, category handling, visibility rules, and related systems may be changed at any time.

Payment does not guarantee acceptance, publication, placement, ranking, visibility, impressions, clicks, conversions, or any performance outcome. A paid advertisement may remain non-live, may be rejected, may be removed, or may perform poorly.

Any estimate, projection, ranking indication, overtake estimate, or similar output displayed through the Service is informational only and is not a promise, warranty, or guarantee.

  • leads;
  • revenue;
  • business result; or
  • period of display.

9. Payments; Fees; Refunds

The Advertiser agrees to pay all fees, funding amounts, and charges incurred through the Service. Payments are processed through third-party payment processors. Podium Atlas does not store complete payment card details on its own systems.

Unless otherwise stated on the Service at the time of purchase, all fees are charged in U.S. dollars. The Advertiser is responsible for any taxes, duties, levies, or similar governmental charges associated with its use of the Service, other than taxes imposed on Podium Atlas's net income.

All fees are non-refundable except where required by law or where Podium Atlas, in its discretion, expressly approves a refund. Payment does not guarantee any outcome, including review approval or advertising performance.

Before initiating any payment dispute or chargeback with your payment provider, you agree to contact Podium Atlas at support@mail.podiumatlas.com to attempt resolution. Podium Atlas will respond to good-faith billing inquiries within a reasonable time.

Podium Atlas may refuse, delay, reverse, or cancel a payment-related action, and may keep an advertisement non-live, if required or permitted by payment processor rules, card network rules, fraud controls, legal obligations, security concerns, or platform review.

If a payment is reversed, disputed, declined, or not successfully collected, Podium Atlas may suspend related advertisements or accounts and may reverse live or pending status associated with that payment.

10. Reporting; Monitoring; Investigations; Enforcement

Advertisements, lists, submissions, profiles, links, and other content or activity may be flagged and reviewed by users, administrators, or automated systems. Podium Atlas may monitor use of the Service and may investigate any suspected abuse, violation, fraud, infringement, misconduct, manipulation, or unlawful activity.

You may not use unauthorized bots, scripts, automation, coordinated manipulation, spam, or abusive behavior to distort lists, rankings, submissions, saves, follows, rewards, visibility, advertising placement, or other platform signals.

In connection with any review, report, investigation, or enforcement matter, Podium Atlas may request information, require modifications, preserve records, limit visibility, remove content, suspend advertisements, restrict list participation, suspend or terminate accounts, refuse future submissions, or cooperate with payment processors, regulators, law enforcement, or other third parties.

Podium Atlas may limit, restrict, remove, or exclude accounts, content, or activity that appears to violate these rules, consistent with our policies and applicable law. Podium Atlas may take protective action based on suspected abuse or suspected violations and is not required to wait for final proof before acting.

11. Privacy; Data; AI

Use of the Service is also governed by the Privacy Policy, which is incorporated into these Terms by reference.

Podium Atlas collects and processes information as reasonably necessary to operate, secure, review, support, and improve the Service.

Podium Atlas does not sell personal information to third parties.

Podium Atlas may use manual and automated tools, including AI-assisted tools, in connection with review, moderation, abuse detection, ranking support, analytics, quality control, and optimization of the Service.

12. Third-Party Services and Links

The Service may rely on or interoperate with third-party services, including payment, hosting, storage, authentication, analytics, and email services. Podium Atlas is not responsible for the acts, omissions, content, policies, or availability of third-party services.

Advertisements, list items, creator links, and destination URLs may direct users to third-party websites or services not controlled by Podium Atlas. Podium Atlas does not endorse and is not responsible for third-party content, products, services, or representations.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODIUM ATLAS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, PERFORMANCE, OR UNINTERRUPTED ACCESS.

WITHOUT LIMITING THE FOREGOING, PODIUM ATLAS DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, AVAILABLE AT ANY PARTICULAR TIME, FREE OF HARMFUL COMPONENTS, OR SUITABLE FOR ANY PARTICULAR BUSINESS OBJECTIVE, AND DOES NOT WARRANT THAT ANY ADVERTISEMENT, LIST, SUBMISSION, RANKING, OR OTHER CONTENT WILL BE ACCEPTED, DISPLAYED, RANKED, INCLUDED, OR PERFORM AS EXPECTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODIUM ATLAS AND ITS AFFILIATES, SERVICE PROVIDERS, LICENSORS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF PODIUM ATLAS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE TOTAL AMOUNT PAID BY YOU TO PODIUM ATLAS THROUGH THE SERVICE IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Podium Atlas and its affiliates, service providers, contractors, and representatives from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your Advertising Content, List Content, destination URLs or linked content, your use of the Service, your violation of these Terms, your violation of applicable law, or your infringement, misappropriation, or violation of any third-party rights.

16. Suspension; Termination

Podium Atlas may suspend or terminate your access to the Service, any account, advertisement, list, submission, or participation feature at any time, with or without notice.

Upon suspension or termination, your right to use the Service ceases immediately. Suspension or termination does not relieve you of payment obligations already incurred and does not entitle you to a refund except where required by law or expressly approved by Podium Atlas.

Podium Atlas may retain records and materials as reasonably necessary for legal compliance, enforcement, dispute resolution, audits, backup integrity, and operational continuity.

17. Changes to the Service and These Terms

Podium Atlas may update these Terms at any time by posting the revised version on the Service. For material changes, Podium Atlas may provide notice via email or a prominent notice on the Service. The updated Terms become effective upon posting or on the effective date stated in the revised version. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

18. Governing Law; Venue

These Terms are governed by applicable federal law of the United States and, to the extent state law applies, the laws of the State of New York, without regard to conflict of laws principles.

Subject to applicable law, any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New York, and each party submits to the personal jurisdiction of those courts.

19. General

These Terms, together with the Privacy Policy and any additional terms expressly incorporated into these Terms, constitute the entire agreement between you and Podium Atlas regarding the Service and supersede prior or contemporaneous understandings relating to the Service.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. A failure to enforce any provision is not a waiver. You may not assign or transfer these Terms without Podium Atlas's prior written consent. Podium Atlas may assign these Terms in connection with a reorganization, asset transfer, merger, sale, or other business transaction.

Your use of the Service, and your electronic acceptance of these Terms, constitute your agreement to transact electronically with Podium Atlas.
